Attorney Yunus Gümüş, stating that he repeated his previous statements, said, “There are 150 testimonies of this incident, which is accepted by all parties. “The crime of the accused is fixed, so we demand that he be punished,” he said.
Lawyer Serkan Toper, on the other hand, claimed that the statements of the victims and the statements of the witnesses were inconsistent and demanded that Özçivit be acquitted, saying, “The allegation that 150 people were cursed by looking into their eyes is against the ordinary course of life.”
The court, which decided the case, decided that the accused Burak Özçivit should be sentenced to a judicial fine of 3 thousand liras before the crime of “insult”. Considering that the accused had not been previously convicted of an intentional crime and that there was no negative behavior reflected in the file, the court gave a positive opinion that the accused would not commit a crime again. For these reasons, the court decided to defer the announcement of the verdict.
FROM THE CLAIM
In the indictment prepared by the Beykoz Chief Public Prosecutor’s Office, Burak Özçivit took place as a ‘suspect’. In the indictment, Mehmet K., Turgay A., Atakan Ö. and Okan Ş. took place as set workers in the TV series “Kuruluş Osman”, which was shot in Beykoz Riva.
It was recorded that on December 8, 2020, the day of the incident, Burak Özçivit, the lead actor of the series, came out of the tent where he was and spoke swearing and insulting words to the complainants. It was emphasized in the indictment that the people cited by the complainants as witnesses confirmed the incident, while the suspects Burak Özçivit stated that the incident had happened.
In the evaluation part of the indictment, it was stated that “If it is seen that there are mutual witness statements regarding the incident in question, when all the investigation documents are evaluated together, there are enough suspects to file a public lawsuit against the suspect committing the crime against him”.
It was also stated in the indictment that the crime in question was subject to reconciliation, the file was sent to the mediator, but the parties could not come to an agreement.
In the indictment, the pending suspect, Burak Özçivit, was demanded to be sentenced to 3 months, 15 days, 4 years and 1 month in prison for the crime of “continuously insulting publicly”.
